Procurement Group Successfully Obtains Court Order Preventing Federal Government Contract Award

In June 2007, Gowlings' procurement group successfully obtained an interlocutory injunction motion in the Federal Court of Appeal, restraining the federal government from proceeding with a contract award until the client's application for judicial review was heard. This is a very noteworthy victory, since such injunctions are very rarely granted in tendering cases. Judges tend to take the view that, as contract cases, any harm is compensable in damages. In this case, however, the Judge found that the potential loss of a contract representing 70% of the client's revenues met the test of irreparable harm.
